Today I was the Buyer at the Closing for a 3-acre tract of land. Later in the day, a note was placed on my car asking that I call my new neighbor, who had previously owned this 3-acre tract prior to today's Seller's ownership. I called the previous owner, and he told me he will file suit tomorrow against today's Seller of my new property, claiming that they had an oral agreement a year or so ago that the tract was to be limited to one acre. Today's Seller apparently had gotten the tract surveyed 16 months ago for 3 acres (rather than only 1 acre), and has had a deed for 3 acres, but never provided a copy of the survey to the previous owner. The previous owner is furious and intends to reclaim the two extra acres via his lawsuit. I don't want to give up the land, since I purchased it for only 2/3rds of the appraisal value. What actions should I take? What are my rights and obligations? Roger C.
