I'm a licensed large family child care provider. A parent is trying to sue me because I was charging a higher rate than what was in the agreement I originally gave her. I had to charge a higher rate because her son was not potty-trained. She paid the higher rate from the beginning. Does she have a valid claim against me? My rates in the agreement are set by age group & unfortunately I didn't state anything regarding requirement to be potty-trained to be charged at the 2-5yr old rate. I was charging her the 0-1yr old rate because her son was not potty trained although he is 2.5yrs old. He was enrolled for 6 months, and ended enrollment last week.
