Is a court order necessary for divorce in canada? Anything happeneds we run to court and that is how life is. In divorce case, a court order is not always required in family disputes. If the parties can come to an agreement then they can enter into a separation agreement that sets out the agreed upon terms. If they can't come to an agreement or if one party is concerned that the other will not comply with an agreement, one of the parties may want to obtain a court order to determine what the arrangements will be (for example what support will be paid) and to enforce those arrangements.
