Question:

International Child Custody/ Does Father have to return US citizen child to mother in Peru?

Nov 2006 Ex GF(immigrant from PERU') took Florida US born child to our native country PERU' for visit and never returned. We had no court orders for custody and I didnt fight her to bring him back I thought she would return eventually. I have since become a US Perm Resident married to US Citizen and we both have professional jobs stable life and home and I want to see my son (he is now 3.5 yrs) and have my rights as a father. In 2.5 yrs his mother only allows for some contact via phone and occassionlly with my family in PERU' so that he and I can enjoy webcam visitations.. She has allowed him to visit US for a total of only 28 days. I request always for visits but she only allows for those few days. I am in turmoil. She is now allowing him to come visit for 2 weeks May 2009.. My 2 questions : 1.... Since he is an American Citizen and I am stable in US can I keep him and not send him back to PERU' until I can figure out how to obtain my rights? I don't want to keep him from his mom, he needs her also, but I want legal rights to have partial custody with visitation. She is unable to come to USA for overstaying her visa so she can not come here and abduct him, but if i keep him 2: Am I considered to be abducting him from PERU' even though he is US Citizen?? I have notarized permit for his travel signed by his mother. PLEASE HELP!! I know i have to contact a lawyer but hoping for a little guidance until i can obtain one..
