If you are charged with theft under 500 is it a criminal act?

I have my question regarding theft under 500. If someone is charged of theft under 500 and gets arrested after committing such a crime, provided that he or she does not lie before the police and shows maximum cooperation. Is there a possibility that the person guilty gets probation if the amount theft is not a big one?

     There is always a possibility for probation, though this would largely be depending on the circumstances. However, payment of restitution would likely be a condition of probation. In any case this is strongly recommended to hire an attorney, who would be there to give some advice about all the rights and to work out such a deal with the prosecutor. The fact that the accused has no prior history should be a justifying factor, in trying to negotiate a settlement with the Defense Attorney, as well as in receiving a sentence from the Judge. It is better hiring localized counsel, who specializes in handling criminal defense cases. Anytime criminal charges are involved it is always advisable to have legal counsel. An experienced lawyer can possibly get the charge dismissed on a technicality or possibly at least get it reduced. As first-time offender, they may also be able to arrange for "diversion" (or the equivalent remedy on your state). This is an alternative sentencing program whereby you plead guilty to the charge, receive a special probation, and upon successful completion of the probation your case dismissed. It should be noted that Diversion is typically allowed only once.
