How do judges decide custody of, or access to, a child in Ontario? This question normally suppose to follow a step by step process but if you look at the decissions; it is more tilted towards women then men. In any regards, here is how the deiccison is made:
Both the Children's Law Reform Act and the Divorce Act say that decisions about child custody and access are based on the best interests of the child. Factors taken into consideration include:
o The ability of each parent to care for the child
o The ties between the child and each parent
o The stability of the child's current living arrangements
o The strength of each parent's plan to care for the child in the future, and,
o The child's wishes (in appropriate circumstances).
The law also states that the judge must consider violence or abuse when assessing a person's ability to parent.
