I bought a two bedroom timeshare. when I went to use it they told me it was a one bedroom. I called the resort and they told me they would correct it. They sent me new papers to sign. They told me not to have them dated or notarized. I mailed them off and then discovered it was a in a different phase. I mailed off a cancellation letter within the ten days. Now they say they did not receive it in time. They must have back dated the contract. What can I do?

It is always advised that before signing any kind of agreement always ask how you can cancel it if things don't work out or if you change your mind. If you don't get a satisfactory reply or you can't figure it yourself by reading the cancellation clauses, then don't sign until you have a lawyer review it for you and advise you. Always remember that Exclusive Right-to-Sell listings keep a safety or protection clause. If you ask an agent after the fact to cancel the agreement and the agent denies, call the agent’s broker and request a cancellation. In case if the broker refuses your request for cancellation, then ask the broker to assign another agent to you. Usually brokers who want to maintain good society relations will cancel a listing if the buyer insists. Nobody wants to be famous for holding a gun to the buyer’s head. If you find that there is no suitable solution, make a call to real estate lawyer for termination assistance, however first, tells the broker of your intentions to do so. Sometimes that’s enough to get a freedom.
